TERMS AND CONDITIONS
When booking with Sugarbag Safaris (ABN 20 334 435 582) (“Operator”), you acknowledge that you have read and understood these terms and conditions (“Terms”). You agree that these Terms will apply whenever you register to, sign on, purchase or book our services.
The Operator provides tailor-made private tours and is a specialist of Kakadu National Park and the Top End of the Northern Territory (“Services”).
Liability Waiver Agreement
Please download, and read the Sugarbag Safaris, Recreational Activities, Liability Waiver Agreement (PDF) this document will be sent with each booking, to be signed at the start of your tour or when you place your booking. This is an important document which affects your legal rights and obligations. Please read it carefully, and do not sign it unless you are satisfied that you understand it. If you are unsure about anything, you should obtain legal advice.
Medical
You are responsible for assessing whether the Services are suitable for you. The Operator does not provide medical advice. It is your responsibility to evaluate the risks and requirements of each aspect of the Services based on your unique circumstances, limitations, fitness level and medical conditions.
1.1 You confirm that you are physically fit and suffer no medical condition which may be aggravated by this Service.
1.2 You consent to receive medical treatment in the case of injury, accident or illness during the Services and to indemnify the Operator in respect of this treatment.
1.3 The Operator reserves the right to request further information or professional medical opinions where necessary, as determined in its discretion, for your safety or the safe operation of a Service.
1.4 Where the Operator determines that your physical or mental condition renders you unfit for any or all parts of the Services, the Operator reserves the right to deny you permission to travel or participate in any Services at any time and at your own expense.
1.5 Travel with the Operator may involve visiting remote or developing regions, where medical care may not be easily accessible, and medical facilities may not meet the standards you are accustomed to. The Operator makes no representations and gives no warranties about the availability or standard of medical facilities in those regions.
Changes to booking
2.1. The Operator reserves the absolute right to cancel any service as a result of any unforeseen event or circumstances or acts of nature.
2.2 bookings will be created through a booking email and separate invoice crated by Xero, when using their website, please review the Terms and Conditions and Privacy Policy of Xero, the Operator carries no liability for any loss or damages as a result of Xero’s website.
2.3 The Operator accepts no responsibility for any loss suffered or additional expenses incurred by you that arise from changes, delays or cancellations to/of the Services.
2.4 If by reason of any fact, circumstance, matter or thing beyond the reasonable control of the Operator or you, as a result of COVID-19, either the Operator or you is/are unable to perform in whole or in part any obligation under this agreement, you will be issued a credit note by the Operator for the amount paid by you for use with the Operator to be used within 12 months of the original booking date.
2.5 In accordance with clause 2.4, when using the credit note, you must give the Operator one months’ notice prior to the booking of a new Service.
Payment Terms
3.1 All Services require a 10% non-refundable deposit, with the remainder of the amount owing to be paid 30 days prior to the departure of a Service.
3.2 All Services are to be paid using bank transfer or cash by direct booking with the Operator.
3.3 You may cancel your booking by notifying the Operator. Cancellation fees, found under “Cancellation of a Service”, will be determined concerning the date on which notice of cancellation is received by the Operator and are expressed as a percentage of the total price paid for the cancelled services.
Cancellation of a Service
Private Tours:
A Private Tour means a tour in which a group booking will be made to fill a vehicle.
(a) a minimum of 10% deposit will be made payable at the time of booking the Services, which deposit is not refundable except for clause 2.1.
(b) Cancellations made 30 to 60 days prior to the departure of the Service will incur a cancellation fee of 50% of the total fee payable for the Service by our standard payment terms in clause 3.2.
(c) Cancellations made within 30 days prior to the departure of the Service will incur a cancellation fee of 100% of the total fee payable for the Service by our standard payment terms in clause 3.2.
